1 1 1 1 17 WorldWide Drilling Resource ® MARCH 2019 Oil/Water Exploration by Harold White I got sued one time for drilling a well in a lady’s flower garden. This lady asked me to locate a good spot to drill a well. I found places to drill where several creeks crossed over and under each other, but the one in the flower garden seemed the best. So I said that being on top of a mountain like it was, I would have a better chance if I drilled in the garden area. She said if I thought it was the best place, to drill there. So I drilled in the garden spot and got a good well. She was happy with the well, but not happy about what happened to her beautiful flower garden. She did not pay me that day and I thought she would in a couple of days or so, but I got a notice to appear in court. When the woman came into court, she had crutches, walking like she had been hit by a train. She had one guy on each side helping her. The judge must have known her because he looked over her papers and said, “You seem to have a habit of this. Case dismissed.” I thought it was because she started talking about the beautiful flower garden, which I thought would have little relation to the well, but I later heard she sued contractors and was well-known for doing so. The following are some things I have been told by some contractors: . When a client tells the drilling contractor where to drill, the contractor has no fault as to whether there is water there or not. . If the drilling contractor thinks the spot picked by the client may not produce water, then the contractor may mention these as concerns or probabilities. . Statements accidentally misleading a client can cause problems and cause lawsuits. . No one knows the answers to the questions about how many gallons a drilling will produce or at what depth, and if it will be salty, arsenic, or sulfuric. . What chemicals will be in the water. The question really is: “Will the water be of good taste and potable?” Who knows? Drill operators, helpers, and anyone who is part of the drilling company saying any misleading statements to the client could cause the possibility of a lawsuit against the company.
