38 JULY 2014 WorldWide Drilling Resource ® EPA Revises Permitting Guidance for Hydraulic Fracturing Adapted from Information Provided by the U.S. Environmental Protection Agency The U.S. Environmental Protection Agency (EPA) announced new under- ground injection control (UIC) program permitting guidance for wells using diesel fuels during hydraulic fracturing activities. The revised guidance was developed to help explain how companies can comply with the law which exemp t s hy - draulic fractur- ing operations from the require- ment to obtain a UIC permit, ex- cept in cases where diesel fuel is used as a fracturing fluid. Along with the guidance, the EPA is also issuing an interpretive memorandum, which clarifies that class II UIC require- ments apply to hydraulic fracturing activ- ities using diesel fuels, and defines the statutory term diesel fuel by referencing five chemical abstract services registry numbers. The guidance outlines for EPA per- mit writers, where EPA is the permitting authority, existing class II requirements for diesel fuels used for hydraulic fractur- ing wells, and technical recommendations for permitting those wells consistently with these requirements. Decisions about permitting hydraulic fracturing operations using diesel fuels will be made on a case-by-case basis. The facts and circumstances of the spe- cific injection activity, applicable statutes, regulations, and case law will be consid- ered. Although developed specifically for hydraulic fracturing where diesel fuels are used, many of the recommended prac- tices are consistent with the best practices for hydraulic fracturing in general, includ- ing those in state regulations and model guidelines developed by industry and stakeholders. Therefore, states and tribes responsible for issuing permits and/or updating regulations for hydraulic frac- turing may find the recommendations helpful with improving the protection groundwater supplies and the overall public health. The EPAcontinues towork with states and stakeholders to ensure the extraction of unconventional oil and gas resources in the U.S. does not come at the expense of public health or the environment. They are moving forward on several initiatives such as this one to provide regulatory clarity with respect to existing laws and using existing authorities where appro- priate.
